Terms of Service

These Terms of Service (“Terms”) govern the provision of photography and videography services by 83 Weddings (“Company,” “we,” “us,” or “our”) to the client (“Client,” “you,” or “your”). By booking services, submitting a retainer, signing a service agreement, or otherwise engaging 83 Weddings, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Services
83 Weddings provides professional wedding photography and videography services, including but not limited to event coverage, edited digital images and/or video, albums, prints, and other products as agreed upon in writing.

83 Weddings provides services throughout California, Arizona, Utah, New Mexico, and Texas, and may travel to additional locations by mutual written agreement.
Specific services, deliverables, coverage hours, pricing, and timelines are detailed in the signed service agreement or booking confirmation (“Service Agreement”).

2. Booking & Retainer

• A non-refundable retainer is required to reserve the event date.

• No date is considered secured until both the retainer and signed Service Agreement are received.

• The retainer is applied toward the total package price.

3. Payment Terms

• The remaining balance is due no later than 14 business days prior to the event date, unless otherwise stated in the Service Agreement.

• Failure to remit payment by the due date may result in cancellation of services with no obligation on the part of 83 Weddings to perform.

• All prices include tax and travel fees.

4. Cancellation & Rescheduling
Client Cancellation

• All retainers are non-refundable.

• If Client cancels services for any reason, refunds of any additional payments will be governed by the Service Agreement.

Rescheduling

• Requests to reschedule are subject to availability.

• If 83 Weddings is unavailable on the new date, the reschedule shall be treated as a cancellation.

5. Coverage & Cooperation

• Client agrees to provide a detailed event timeline, vendor contact information, and venue access.

• Client acknowledges that coverage quality and quantity are affected by cooperation of guests, venue restrictions, lighting conditions, weather, and adherence to the agreed schedule.

• 83 Weddings is not responsible for missed or compromised coverage due to delays, restrictions, interference by guests or vendors, or conditions beyond our control.

6. Artistic Style & Editing

• Client acknowledges familiarity with 83 Weddings’ portfolio, style, and approach.

• Editing style, color grading, cropping, and creative decisions are made at the sole discretion of 83 Weddings.

• Requests for revisions or re-edits may be granted at our discretion and may incur additional fees.

7. Delivery of Images & Video

• Estimated delivery timelines are outlined in the Service Agreement and are estimates, not guarantees.

• Final images and videos are delivered digitally unless otherwise agreed.

• 83 Weddings is not obligated to retain files beyond 12 months following final delivery.

8. Copyright & Usage Rights

• All photographs and video remain the exclusive copyrighted property of 83 Weddings.

• Client is granted a non-exclusive, non-transferable, personal-use license to print, share, and display the delivered media.

• Client may not sell, alter, license, or use the media for commercial purposes without prior written consent from 83 Weddings.

9. Portfolio Use & Model Release
Unless Client opts out in writing prior to the event, Client grants 83 Weddings permission to use images and video from the event for portfolio display, website use, social media, advertising, competitions, publication, and other promotional or educational purposes. Client represents that they have authority to grant this permission on behalf of event attendees.

10. Limitation of Liability

• 83 Weddings’ total liability for any claim, loss, or injury arising from services provided shall not exceed the total amount paid by Client.

• 83 Weddings is not liable for damages resulting from missed moments, equipment failure, data loss, weather conditions, venue limitations, guest behavior, or acts beyond reasonable control.

• In the event of catastrophic failure preventing delivery of services, liability is limited to a refund of payments received.

11. Substitution of Photographer or Videographer
In the event of illness, emergency, or circumstances beyond control, 83 Weddings reserves the right to substitute a qualified professional of comparable skill or issue a refund at our discretion.
12. Force Majeure

83 Weddings shall not be held liable for failure or delay in performance due to causes beyond reasonable control, including but not limited to acts of God, natural disasters, public health emergencies, government restrictions, or acts of terrorism.

13. Client Responsibilities & Indemnification

• Client is responsible for obtaining all venue permissions, permits, and approvals.

• Client warrants that they have the authority to enter into this agreement.

• Client agrees to indemnify and hold harmless 83 Weddings from any claims, damages, or liabilities arising from breach of these Terms or actions of the Client or event attendees.

14. Governing Law
83 Weddings provides services in California, Arizona, Utah, New Mexico, and Texas. Notwithstanding the location of the event or Client residence, these Terms and any related agreements shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

15. Venue & Dispute Resolution
Any dispute, claim, or legal action arising out of or relating to these Terms or services provided by 83 Weddings shall be brought exclusively in the state or federal courts located within the State of California. Client consents to personal jurisdiction and venue in such courts and waives any objection based on inconvenience or forum non conveniens.

16. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Amendments
83 Weddings reserves the right to modify these Terms at any time. The version in effect at the time of booking shall govern unless otherwise agreed in writing.

18. Entire Agreement
These Terms, together with the Service Agreement, constitute the entire agreement between the parties and supersede all prior negotiations, representations, or agreements, whether written or oral.
